The Private Attorneys General Act (PAGA) allows employees to file lawsuits against their employer and to recover civil penalties on behalf of themselves, other employees, and even the State of California! Although wage and hour claims are the most common type of a PAGA claim, they can also be made for retaliation, misclassifying employees, and failure to protect the health and safety of employees. Even the most cautious employers run the risk of substantial penalty exposure in the event they are found to have violated provisions of the Labor Code – no matter how small.
